The identification number (IDDN) that was assigned to it, and which accompanies the software and associated publications, is IDDN.FR.001.180002.000.R.P.2005.000.30100.\par

\ul\i Educational Version of InraPorc\ulnone\i0 :\i  \i0 the royalty-free version of \i InraPorc\i0  to be used for academic purposes only (i.e., by individuals affiliated to an educational institution). Only a limited number of user data can be saved.\par

\ul\i Database\ulnone\i0 : means the \ldblquote INRA-AFZ Database\rdblquote  and consists in the following:\par

\ul\i{\pntext\f1\'B7\tab}Use\ulnone\i0 : means the access to the \i Software\i0 , the downloading, installation, execution, and copying of the \i Software\i0  or any other benefit resulting from using its functions.\par

\ul\i{\pntext\f1\'B7\tab}INRA\ulnone\i0 : means the Institut National de la Recherche Agronomique, Paris, France, as well as any affiliate(s) of \i INRA\i0 .\par

\ul\i{\pntext\f1\'B7\tab}AFZ\ulnone\i0 : means the Association Fran\'e7aise de Zootechnie.\par

\ul\i{\pntext\f1\'B7\tab}Academic End-user\ulnone\i0 : means the beneficiary of this license who is employed by a non-profit organization with the purpose to conduct research or for educational purposes, hereafter referred to as \ldblquote\i You\i0\rdblquote .\par

\ul\i{\pntext\f1\'B7\tab}Server\ulnone\i0 : means the server from the \i INRA\i0  Research Centre in Rennes, from which the \i Academic End-user\i0  can download the \i Educational Version of the Software\i0  (http://www.rennes.inra.fr/inraporc/).\par

\ul\i{\pntext\f1\'B7\tab}Domain of the License\ulnone\i0 : means research and development activities with the purpose to generate scientific knowledge or teaching. Any commercial use is strictly prohibited, including providing services to third parties, the sale of information, data or any product of commercial value, except specific and written consent from \i INRA\i0 .\par

{\pntext\f1\'B7\tab}1.2.\tab The \i Database\i0 , as well as any copy of it, is the intellectual property of \i INRA\i0  and \i AFZ\i0 . The structure and the organization of the \i Database\i0  are trade secrets and confidential information that \i You\i0  are not allowed to use or disclose, except for the purposes mentioned in this agreement. \par

{\pntext\f1\'B7\tab}1.3.\tab\i You\i0  agree to respect and not to remove, hide or conceal any copyright, trademark, and indication of confidentiality or any other mention relating to the property or the mark, or legend appearing on \i InraPorc\i0 , the \i Educational Version of InraPorc\i0  and the \i Database\i0 .\par

{\pntext\f1\'B7\tab}1.4.\tab\i InraPorc\i0 , the \i Educational Version of InraPorc\i0  and the \i Database\i0  are protected by intellectual property rights in France and abroad by international agreements on author rights. The breach of one of the authors\rquote  rights constitutes an infringement crime punished in France by articles L335-2 and L343-1 of the law on intellectual property rights and punished by 2 (two) years imprisonment and a 150 000 \'80 fine.\par

{\pntext\f1\'B7\tab}1.5.\tab The authors - \i INRA\i0  and \i AFZ\i0  - reserve all rights that are not expressly cited in the present license agreement.\par

\pard{\pntext\f1\'B7\tab}{\*\pn\pnlvlcont\pnf1\pnindent0{\pntxtb\'B7}}\nowidctlpar\fi-568\li1136\sb240\qj\tx1136\b0 2.1.\tab\i INRA\i0  and \i AFZ\i0  grant to \i You\i0  by this agreement a non-exclusive, royalty-free, world-wide license to \i Use\i0  the \i Educational Version of the Software\i0  (\i Educational Version of InraPorc\i0  and the \i Database\i0 ) for the purposes described above, in the \i Domain of the License\i0  until the 31\super st\nosupersub  of December of the year of the acceptance this agreement.\par

{\pntext\f1\'B7\tab}2.2.\tab After accepting this agreement, \i You\i0  will receive by e-mail a confidential license activation key allowing you to use the \i Educational Version of the Software\i0 . This activation key will be valid until December 31\super st\nosupersub  of the current year.\par

{\pntext\f1\'B7\tab}2.3.\tab\i You\i0  are authorized to download, install, and execute the \i Educational Version of the Software\i0  on your computer to a limit of one license for one computer (i.e., one hard disk).\par

{\pntext\f1\'B7\tab}2.4.\tab For educational purposes (for instance for classroom teaching), \i You\i0  are authorized to download and to install the \i Educational Version\i0  \i of the\i0  \i Software \i0 on a server and to execute the \i Educational Version of the\i0  \i Software \i0 from the server.\par

{\pntext\f1\'B7\tab}2.5.\tab\i You \i0 are not authorized to rent, sell, sublease, distribute, assign, transfer, license, sublicense or otherwise share the \i Educational Version of the Software \i0 or one of the rights of \i INRA\i0  and \i AFZ\i0  on the\i  Software\i0 .\par

{\pntext\f1\'B7\tab}2.6.\tab\i You\i0  are not authorized to personalize the installation of the \i Educational Version of the Software \i0 or extend its functions. In addition, \i You\i0  may not translate, adapt, correct, modify the \i Educational Version\i0  \i of the\i0  \i Software.\i0\par

{\pntext\f1\'B7\tab}2.7.\tab\i INRA\i0  reserves the right to correct errors and to determine the methods dealing with the following acts:\par

{\pntext\f1\'B7\tab}necessary information for the proper working with other software is available from \i INRA, \i0 without implying a commitment for \i INRA\i0  to provide assistance, maintenance or associated services with \i InraPorc\i0  or the \i Educational Version of InraPorc\i0\par

\pard\nowidctlpar\fi-568\li1136\sb240\qj\tx1136 2.8.\tab\i INRA\i0  and \i AFZ\i0  reserve the right to correct errors in the \i Database\i0  without implying a commitment for \i INRA\i0  and \i AFZ\i0  to provide to provide assistance, maintenance or associated services with the \i Database\i0 .\i\par

\i0 2.9.\tab\i You \i0 are not authorized to extract (i.e., transfer permanently or temporarily) whole or a part of the content of \i InraPorc\i0 , the \i Educational Version of InraPorc\i0  or the \i Database\i0  to another medium, by any means and in any form. Moreover, \i You\i0  are not authorized to re-use (i.e., release in public) whole or a part of the content of \i InraPorc\i0 , the \i Educational Version of InraPorc\i0  or the \i Database\i0  irrespective its form.\par

\pard\nowidctlpar\fi-568\li568\sb240\qj\tx568\b 3.\tab Limitation of warranty\par

\pard\nowidctlpar\fi-568\li1136\sb240\qj\tx1136\b0 3.1.\tab\i INRA\i0  has no obligation to provide technical support and/or maintenance service for the \i Educational Version of InraPorc.\par

\i0 3.2.\tab\i INRA\i0  and \i AFZ\i0  have no obligation to provide technical support and/or maintenance service for the \i Database\i0 .\par

3.3.\tab\i INRA\i0  grants a license to \i Use\i0  the \i Educational Version of InraPorc\i0  on an \ldblquote as is\rdblquote  basis without warranties, either express or implied of any kind, of merchantability, fitness for a particular purpose or for any kind, and without any obligation for \i INRA\i0  to provide complementary services or technical support.\par

3.4.\tab\i INRA\i0  and \i AFZ\i0  grant a license to \i Use\i0  the \i Database\i0  on an \ldblquote as is\rdblquote  basis without warranties, either express or implied of any kind, of merchantability, fitness for a particular purpose or for any kind, and without any obligation for \i INRA\i0  and/or \i AFZ\i0  to provide complementary services or technical support.\par

3.5.\tab\i You\i0  recognize that current scientific and technical knowledge does not allow to test and verify all uses of the \i Educational Version of the Software\i0 , or to detect existence of possible defects. \i You\i0  recognize that the \i Educational Version of the Software\i0  should be used only by knowledgeable users and that its \i Use\i0  comprises some risks.\par

3.6.\tab\i You\i0  are responsible for determining the appropriateness of the \i Educational Version of InraPorc\i0  to your needs, for the control of its functioning, and for its \i Use\i0  under conditions that will cause no personal harm or property damage.\par

3.7.\tab The \i Educational Version of the Software\i0  is provided on an \ldblquote as is\rdblquote  basis without any other guaranty than the existence of the \i Educational Version of the Software\i0  either express or implied, including the exclusion of guaranty regarding any title (of property or exploitation), lack of infringement, commercial quality, secured character, innovating and relevant nature of the \i Educational Version of the Software\i0 , the absence of errors, and compatibility with your equipment and/or software configuration.\par

\pard\nowidctlpar\li568\sb240\qj\b0 In case of failure of the \i Academic End-user\i0  to comply with any term of this agreement, the license will automatically terminate. In case of termination, \i You\i0  must immediately destroy the \i Educational Version of the Software\i0  as well as any copy, adaptation, improvement or any part of the \i Educational Version of the Software\i0  merged with other software.\par
